Two advocates tried to file a writ petition at the Supreme Court demanding the court issue a mandamus telling Prime Minister KP Sharma Oli to secure a vote of confidence in the House of Representatives immediately.
The court, however, rejected hearing the case.
Claiming Oli was required to seek a vote of confidence within one month since the Supreme Court order on March 7 divided his party, advocates Amita Gautam Paudel and Kirtinath Sharma Paudel had taken a petition at the court on Tuesday. However, Chief Registrar Lal Bahadur Kunwar had rejected the petition saying it did not meet the criteria.
Following the rejection, they filed another petition demanding the earlier petition be registered. Hearing that today, a single bench of Justice Bam Kumar Shrestha said the chief registrar’s decision was constitutional.
The court’s rejection comes at a time when some politicians and experts are saying that Oli needs to prove that he commands a majority in the House because the Nepal Communist Party has been divided into two following a Supreme Court. and one of the two parties, CPN-Maoist Centre, is protesting the government.
Just a few days ago, Oli’s confidant Pradeep Gyawali had said Oli was not required to secure a vote of confidence arguing the court order just revived the old parties that were in existence when Oli was elected the PM in 2018, hence it should not be considered a split.
